Mrs. Rivera who suffers from MD and is disabled, is diagnosed with breast cancer in April of 2013. To assist with her cancer recovery, Mr. Rivera a career indefinite employee, acquires a FMLA through December 31, 2013. LLNS dismisses Mr. Rivera before that date. Such a dismissal is potentially a violation of DOL protections on top of the DOE Whistleblower matter.
Then in January of 2014, after analyzing the details of Mr. Rivera's dismissal for alleged misconduct, a CA Unemployment Benefit Appeals Judge determines LLNS fired Mr. Rivera for "reasons other than misconduct". A shameful and sad state of affairs here at LLNL under LLNS management. Perhaps a Triad National Security like contractor will acquire the contract to manage LLNL soon, and bring some humanity back to LLNL.
