Was this the first time in history a DOE OHA appeal decision was "vacated" (made null and void)?

I don't know if it was the first time in history an OHA appeal decision was vacated. However, the DOE 708 process does state the following:
"The Secretary will reverse or revise an appeal decision by the OHA Director only under extraordinary circumstances."
Anyone else notice who was the DoE official that made the decision that was vacated / overturned? None other than Kim Laback, now the head of the LANL site office.
