Business as usual with continuing employee thefts at LANL

The new contractor has a long term mess to clean up when they take over next year.

Laws means nothing unless they're enforced. And when they're enforced selectively, law becomes a tool of injustice and oppression. We ARE a nation of laws . . . laws designed to protect the interests of the privileged few and to keep the masses under control. Case in point: Bussolini and Alexander stole at least $350,000 worth of merchandise, and had the lab not chosen to end the investigation into their shenanigans, by firing Glenn Walp and Steve Doran for refusing to cover up the theft, it's likely the amount of fraud would have gone well beyond $350,000, perhaps even into the millions of dollars. But then that would have been an indictment of UC's stewardship in Los Alamos, and the objective at that point was to end the spectacle of a congressional committee asking hard questions about UC's failures in Los Alamos. And to accomplish that, a cover-up ensued that even included the disgraceful cover-up of Richard Burick's role and death. But if it's the little guy stealing a few strands of copper to generate a couple of thousand dollars in added household income (which I don't condone, of course), the powers that be will investigate until hell freezes over and throw the book at him. Rich Marquez (Executive Director for LANL) and John Tapia (Deputy Division Leader, Procurement) continue the roll as thieves as Bussolini and Alexander were and put in prison. They are currently under FBI investigation and both were allowed to resign rather than be fired.

" But then that would have been an indictment of UC's stewardship in Los Alamos, and the objective at that point was to end the spectacle of a congressional committee asking hard questions about UC's failures in Los Alamos. "

The whole things sounds pretty weak. I see lots of failure after the contract change but not much before. The whole idea that UC somehow managed the labs badly just does not hold water. We have been through this on the blog many many times before.

"And to accomplish that, a cover-up ensued that even included the disgraceful cover-up of Richard Burick's role and death."

OMG you have got to be kidding!? There was no cover up, case closed. You sound a delusional bitter nutcase.

Anonymous said...

Well I have to say this blog does tend toward the nutcase. For example the allegations that LANL has thugs that go out and beat up whistleblowers. Are you kidding? They have managers and departments that take care of true whistleblowers. Only nut jobs who get drunk at a strip club and nearly run over some people seem to get beaten up.

Many many audits followed the Bussolini thefts. Are all of the auditors in some great conspiracy as well?

The thing about Walp and Doran was they thought every person from the valley was in some vast conspiracy to defraud LANL. They weren't white knights come to clear the kingdom of corruption, it seemed to be more a white thing.

You claiming that "Rich Marquez (Executive Director for LANL) and John Tapia (Deputy Division Leader, Procurement)" are currently under FBI investigation?

Anonymous said...

John Tapia has hired a criminal defense attorney since his resignation. This attorney represented former Manny Aragon, NM Senate Pro-Tem. Aragon, an Albuquerque Democrat who was once one of the state’s most powerful politicians, pleaded guilty in October 2008 to one count of conspiracy and two counts of mail fraud in a Metropolitan Courthouse construction scandal that siphoned off more than $4 million.

Aragon had secured state money for various aspects of the courthouse project. He admitted stealing more than $600,000, which he got from an engineer who helped arrange a system of fraudulent overbillings on the courthouse’s audio-visual system. He served four-and-half years for his part in this Albuquerque courthouse kickback scheme.

Your comments are rather disturbing in that you are implying that there is some issue with people from New Mexico. All you have is is all nasty innuendo, ugly allegations and bizzare rumors with a disturbing subtext about the demographic makeup of New Mexico. Take your issues or hate elsewhere. And please get help you sound like a very disturbed person with some serious problems. You are not better than anyone else so try looking in the mirror before you judge the good people of New Mexico.

They caught the guy and he will be prosecuted. How is that business as usual and a mess for the contractor?

I hate all you people at LANL and the NNSA labs. All I have left is hate, hate for LANL, New Mexico, humanity, and ultimately myself. Any accusation I can make up is justified, any outrageous lie I say is for my greater good and profit. I cannot let it go because it means that I must face the truth about what I truly am and I cannot and will not do that. I will fight the truth to the very end. I hate the truth and to the last, I grapple with truth; From Hell's heart, I stab at truth; For hate's sake, I spit my last breath at truth and reality.

What if they are also monitoring your IP address, how would feel about that?

Madam President HRC was given a free pass by Comey on modest sized reckless negligence ...so your alleged what --IP address insult? --will be ignored as well. Cops are scared.

Meanwhile, when did the individual liberal person become so personally helplesss and weak? Grow a thicker hide. These are words not lashes. FolloW Trumpf's behavior in this-- a stick finger to what my opponents think, carry on. PC Nannies can only be effective arbiters of taste if you give them persmission. Nader is the same, durable. why would the FBI care about the comments on this blog. U are trying to intimidate and curtail our freedom of speech. Is this Rich Marquez or Caroline the circle Zerkle or John Tapia

Anonymous said...

It is called "big data" and it is about monitoring all violence, threats of violence, or potential threats of violence, nation-wide. And it is happening now. On-line "behaviors," including on social media and blogs like this one, are not beneath notice. If you think you are anonymous on this "anonymous" blog, you are very naive.

Anonymous said...

I havent read any sense of violence or potential. All I have read are passionate opinions. No one has yelled fire in a crowded room. Maybe u need to stop participating on this blog if u r so easily hurt or offended or bothered by opinions that dont match your personal values. Last time I looked we r still a democracy of free will and free speech. u can disagree and u can boo and hiss but to envision a state of the union in which we should fear a posting of an opinion on a blog that is meant to b anonymous for obvious reasons then u r out of line to attempt to repress this nlog. Oh thats my opinion.

LANL's method of operation aka "intimidation to the workforce" is evident on this blog. If the FBI is monitoring this blog, please investigate the LANL manager(s) using their method of operation to force employees by intimidation to stop informing the public of the corruption within LANL management.

Yes monitor everyone, we are living in a post 9-11 world and we can no longer afford the luxury of something called freedom. Anyone can be threat and must be watched at all times, it is for our safety and security and we can all agree that that comes first and foremost at all costs. This is not the time to question, to raise issues, or to think you are above it all, it is time to follow, believe and be obedient. Maybe sometime in the far future when the threat has passed can you come out give your so called opinion but until then shut up, keep your head down, and let the real adults in the room do the job than needs to be done. So keep the monitoring going it is the only way to save us and our way of life.

All indicating an outmoded idea of privacy and personal freedom. Try reading some information (freely available) about how the Intel agencies are mining "big data." You are going down a road you haven't mapped and haven't tried to see the end of. What you have "seen" or not seen is irrelevant, the government has its own criteria, which you will not be made aware of. No one is trying to "repress" anything. On the contrary, the more information you post, the better for them. You are encouraged to post more of your inane drivel - it aids in more accurately categorizing your profile.

The Government may very well have a complete backup of all your data. Whether they can actually locate it and competently analyze it for legitimate threats is another matter. Actually, going after innocent concerned citizens discussing corporate mismanagement on a public blog would be a sign of true incompetence, kind of like the TSA zealously patting down grandmothers and little babies. Let's hope the NSA is managed better than TSA, or NNSA for that matter.

Anonymous said...

So my data is being mined. Maybe that data will aid in the successful prosecution of senior officials at LANL who committed procurement and timecard fraud and the individuals who covered it up.

Anonymous said...

Move along folks, nothing to see here.

Fraud and coverup are what has kept LANL on the front pages for years.

LLNL entry searches conducted by the thousands.....LLNL exit searches, just a few. What are they looking for? Ask the the guards don't know. Maybe to keep the booze from coming in, wait a minute, it's now legal to bring booze on site. Anything illegal can be brought on site on just throwing it over the fence and picking it up later. So what's being taken the Lab? Anything you want. Their random search test consists of blondes in convertibles. Watch some time and see for yourself. Chuckle if you want, then check the PFD search data.

LANL's tactics are the same as Trump's...fear mongering. Is LANL wanting Russia to hack their employee computer systems? If so, both Trump and LANL are committing treason!!!

How are LANLs tactics like fear mongering?

Anonymous said...

LANS' tactic is fear. LANL, not so much. The two should never be conflated.

I hope they start with Hugh McGovern (still at LANL, currently the Operations Manager at RULOB and RLW) who threatened to kill his employees at WETF if they didn't start closing out PFITS. Senior LANS managers have been warned about this insane maniac, however, they have chosen to ignore this. This loose canon with a lit fuse is just waiting to go off.

Ah yes this psychopath, I thought he had some other issues as well. He is a Bechtel guy right?

Yes, another Savannah River Site (SRS) frankenstein, been at LANL for 6-years, but has 35-years on TCP-1. McGovern was in the control room (probably yelling at folks) during the Three Mile Island (TMI) nuclear accident, probably threatening to kill folks if they didn't shut down the reactor. It's no wonder there was a meltdown. These are LANS managers running LANL nuclear facilities.

Seelinger's analysis was distributed to control
room operators at TM 1-2. Three of those present

Frederick. Hugh McGovern and Craig Faust
discussed the report and the accident. (219) "

Interesting. Well, the FBI needs to start from the top. Rich Marquez had two IT companies and was filtering contracts through Carolyn Zerkle (AD), John Tapia (Deputy Division Leader/Procurement) and Albert Giron, (one of the Division Leaders for IT). Four IT Division are under Carolyn Zerkle. Rich Marquez did not suddenly retire but was forced too! John Tapia is currently under investigation for several federal violations. Time Fraud was one. The other two hopefully are also being investigated.

July 28, 2016 at 7:49 PM

That is nonsense since there is no "LANL" except for some buildings and land owned by the federal government. Both the operating management and the employees are "LANS."

Anonymous said...

Richard Marquez resigned in lieu of termination after it was discovered that he was working a second job as a second tier vendor for IT services at LANL. His former deputy is the AD for the IT function and his former chief of staff is a division leader in IT. His protƩgƩ, the deputy manager for procurement and the warehouse, also resigned in lieu of termination after it was discovered that he was also working a second job during his LANL work hours (like father like son?).

While employed with a $500K annual salary as a senior leader at LANL, he was able to generate revenue as a second tier contractor at LANL for his business selling IT services. Who was the requester and who approved the IT acquisition? Who was the first tier contractor? Collusion?

There IS a "LANL", comprised of world class people and facilities, that IS separate and distinct from "LANS" LLC, which is comprised of world class corporate clowns and Beltway bandits. Do not confuse the two. One serves the country and the other serves themselves.

Jeez you are dense, there is no LANL, it is just buildings and lots, you work for LANS and are part of LANS like it or not. In real world you do not hear workers complain about the company they are part of. LANL is a very strange place where the workers do not know who they work for and the company is not allowed to rapidly swap out people to get the right attitude on the workforce. You people are clever and think you can wait us out!

It is not your place to judge the LLC you work for, it is you place to work for its success and yes the success of the LLC comes first over your own preconceived version of what "serves" the country. Google does not ask itself what is best for the country it ask itself how it can make money, and guess what in the end it is good for the country! Imagine that and it would just the same for LANS only if everyone is on board.

Anonymous said...

The llc has failed. You are truly dense and, yes they swapped out lots of people. Bad managers are bad managers no matter what you call yourselves.

blathered July 30, 2016 at 7:38 AM

Really? Just try to find a refereed journal publication in which the authors list their affiliation as LANS rather than LANL, or in which LANS is even acknowledged. LANS is merely a shadow company with no assets or technical competence. LANS will soon shrivel up into its alter-ego, LLNS, and all of you LANS sycophants will be out on the street.

July 30, 2016 at 10:06 AM

And all of you "LANL employees" will actually be employees of yet another NNSA contractor that is NOT UC and will still try to pretend that "LANL" still exists. Publication affiliations don't matter. Who signs your paycheck does. You can't hide that.

Anonymous said...

July 30, 2016 at 5:51 PM Just doesn't get it. It is no different now than it ever was. LANL (nee LASL) employees' paychecks were signed by UC for 60 years before LANS became the operator. The laboratory (LANL)is owned by the Federal government and since being privatized in the 1940s it has always been operated by contractors, first UC and now LANS. Paychecks have always been signed by the contractors. Nothing about LANLs "existence" as a GOCO has changed since it's inception to replace the Federal Project Y.

Anonymous said...

July 31, 2016 at 8:43 AM

False, you are LANS employees and all that it entails, we have a shared fate just like any other company, and we have a shared goal you are here to make money and LANS is here to make money just like it works in every other business. The 60 yeas of UC running the labs is over it will never ever come back. If you want the next for profit LLC to succeed you better be loyal to the company and lose the who " I am a LANL employee" bit.

It is strange how the corporate windbags try to associate themselves with the successful scientific endeavors of those who curse them. Try as they might, the truth about their emperor and about their faux empire is that the former has no clothes, and the latter no substance. The sooner you Bechtel sycophants die off the better. Don't let the door hit you on the way out.

Anonymous said...

Well, I'm sure everyone at LANL will be happy to see July 31, 2016 at 9:03 AM out the door with his employer (LANS), which has been fired after only ten miserably incompetent years.

From today's Los Alamos Monitor:

Employee is suing "LANS" and "LANL"

"Attorneys for Los Alamos National Security have responded to a 2016 lawsuit from a Los Alamos National Laboratory employee where he said he was discriminated against because of his age and a prior lawsuit he filed against the company in 2013.
The employee filed the new suit in April. Los Alamos National Security is the company that manages and operates LANL.
“Defendant (LANL) has discriminated against the plaintiff by subjecting him to a hostile work environment, denying him promotional opportunities and promoting a younger, less experienced individual, interfering with his ability to perform his job duties and by giving plaintiff a negative evaluation and significantly reducing his promotional opportunities and merit raise,” said his attorney, Donald Gilpin, in the lawsuit.
In his suit, the employee, Michael Irving, also claims that he was passed over for a promotion because of what was contained in the prior lawsuit he lodged against Los Alamos National Security in 2013.
The 2013 suit was about a complaint Irving made to his management about how rules concerning VIP visits weren’t being followed. Irving said as a result of his complaint, management called him a “troublemaker” and had him “removed from his security oversight role with regard to VIP visits,” Gilpin said in Irving’s new lawsuit.
Irving also claims he was demoted two steps.
The 2013 lawsuit was dismissed in 2015 because the judge felt that Irving didn’t pursue every “reasonable avenue” in resolving his issues with management.
In his new lawsuit, Irving and his attorney alleged Security created a new supervisory position, and then promoted the younger, less experienced person, who also happened to be one of the people Irving complained about to security, to be Irving’s supervisor.
An employee reached at the Gilpin law firm was asked to provide the Monitor Irving’s age, but said they could not release that information.
Gilpin also claims that the supervisor made Gilpin’s job more difficult through interference and limiting what he could do.
Irving has been employed by the laboratory since 2006 and is now a “security manager 4.”
The lab replied to Irving’s new lawsuit July 5, denying several allegations in the complaint, including the main one that he was discriminated against.
“Defendant denies... the assumption contained therein that LANS (Los Alamos National Security) ‘created a new position’ in 2014 that was subject to the application process and that LANS refused to allow plaintiff to apply,” said attorney Ellen Casey, an attorney for Los Alamos National Security.
Casey also said in the lawsuit that Irving has again failed to “exhaust administrative remedies” with management before filing another lawsuit against LANL.
Irving is suing for lost wages, benefits, mental anguish and humiliation, punitive damages and the cost of legal fees."
